PD Prize Giveaway Rules

IN A NUTSHELL:
  • Giveaway open to US residents in the lower 48 states (due to shipping restrictions)
  • Entry period ends Friday, June 28th at 11:59pm EST
  • Winner will be chosen at random and contacted within 5 days of contest end date.
  • By entering, you agree to receive occasional emails from Peak Design and LAND Energy.
FULL TERMS

1. Eligibility: The Giveaway is open to legal residents of the continental United States (excluding Alaska and Hawaii) who are 18 years of age or older at the time of entry. Employees of Peak Design, its affiliates, subsidiaries, advertising, promotion and fulfillment agencies, and legal advisors, and their immediate family members and persons living in their same household, are not eligible to participate in the Giveaway.

2. Sponsor: The Giveaway is sponsored by Peak Design, located at 2325 3rd Street, STE 410, San Francisco, CA 94107.


3. Agreement to Rules: By participating, you agree to be fully unconditionally bound by these Rules, and you represent and warrant that you meet the eligibility requirements. In addition, you agree to accept the decisions of Peak Design as final and binding as it relates to the content of this Giveaway.


4. Giveaway Period: Entries will be accepted online starting on Wednesday May 1, 2024 at 12:01 am EST and ending Friday June 28, 2024 at 11:59 pm EST. All online entries must be received by the end of the Giveaway Period.


5. How to Enter: The Giveaway must be entered by submitting an entry using the online form provided at PeakDesign.com/land or via Peak Design lead-generation advertisements on the Meta or Google platforms. The entry must fulfill all Giveaway requirements, as specified, to be eligible to win a prize. Entries that are incomplete or do not adhere to the rules or specifications may be disqualified at the sole discretion of Peak Design. You may enter only once. Multiple entries from the same person will be disqualified.


6. Prizes: The Winner(s) of the Giveaway (the “Winner”) will receive [Custom PD edition Land District Scrambler E-motorcycle including a PD phone mount and accessories. Shipping is included with the prize in the US lower 48 states (continental US). Actual/appraised value may differ at time of prize award. The specifics of the prize shall be solely determined by Peak Design. No cash or other prize substitution shall be permitted except at Peak Design's discretion. Only one prize will be awarded per person. The prize is non-transferable. Any and all prize-related expenses, including without limitation any and all federal, state, and/or local taxes, shall be the sole responsibility of Winner. No substitution of prize or transfer/assignment of prize to others or request for the cash equivalent by Winner is permitted. Acceptance of prize constitutes permission for Peak Design to use Winner’s name, likeness, and entry for purposes of advertising and trade without further compensation, unless prohibited by law.


7. Odds: The odds of winning depend on the number of eligible entries received.


8. Winner Selection and Notification: Winner will be selected by a random drawing under the supervision of Peak Design. Winner will be notified by email within five (5) days following selection of Winner. Peak Design shall have no liability for Winner’s failure to receive notices due to spam, junk e-mail or other security settings or for Winner’s provision of incorrect or otherwise non-functioning contact information. If the selected winner cannot be contacted, is ineligible, fails to claim the prize within 60 days from the time award notification was sent, or fails to timely return a completed and executed declaration and release as required, the prize may be forfeited and an alternate Winner selected.


9. Terms & Conditions: Peak Design reserves the right, in its sole discretion, to cancel, terminate, modify or suspend the Giveaway should virus, bug, non-authorized human intervention, fraud, or other cause beyond Peak Design's control corrupt or affect the administration, security, fairness, or proper conduct of the Giveaway. In such a case, Peak Design may select the Winner from all eligible entries received prior to and/or after (if appropriate) the action taken by Peak Design.


10. Limitation of Liability: By participating in the Sweepstakes, entrants agree to release, discharge, indemnify, and hold harmless the Sweepstakes Sponsor, Peak Design, its respective subsidiaries, affiliates, officers, directors, employees, agents, and representatives (collectively, "Released Parties") from any claims, losses, damages, liabilities, including legal fees and expenses, arising out of their participation in the Sweepstakes or any Sweepstakes-related activities and the acceptance, use, misuse, or possession of any prize awarded hereunder, including, but not limited to: (a) technical failures of any kind, such as malfunctioning of any computer, cable, network, hardware, or software; (b) the unavailability or inaccessibility of any transmissions, telephone, or Internet service; (c) unauthorized human intervention in any part of the entry process or the Sweepstakes; (d) electronic or human error in the administration of the Sweepstakes or the processing of entries; and (e) any injury or damage to persons or property, including but not limited to entrant's computer, hardware or software, which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Prize Giveaway or Sweepstakes.
Furthermore, the Released Parties are not responsible for incorrect or inaccurate entry information, whether caused by Internet users or by any of the equipment or programming associated with or utilized in the Sweepstakes or by any technical or human error that may occur in the processing of the entries. The Released Parties assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries.
NOTWITHSTANDING ANY OTHER PROVISION OF THESE OFFICIAL RULES, THE RELEASED PARTIES SHALL NOT BE LIABLE TO ANY ENTRANT OR WINNER OR ANY OTHER PERSON FOR FAILURE TO SUPPLY THE PRIZE OR ANY PART THEREOF, BY REASON OF ANY ACTS OF GOD, ANY ACTION(S), REGULATION(S), ORDER(S) OR REQUEST(S) BY ANY GOVERNMENTAL OR QUASI-GOVERNMENTAL ENTITY (WHETHER OR NOT THE ACTION(S), REGULATION(S), ORDER(S) OR REQUEST(S) PROVE(S) TO BE INVALID), EQUIPMENT FAILURE, TERRORIST ACTS, EARTHQUAKE, WAR, FIRE, FLOOD, EXPLOSION, UNUSUALLY SEVERE WEATHER, HURRICANE, EMBARGO, LABOR DISPUTE OR STRIKE (WHETHER LEGAL OR ILLEGAL), LABOR OR MATERIAL SHORTAGE, TRANSPORTATION INTERRUPTION OF ANY KIND, WORK SLOW-DOWN, CIVIL DISTURBANCE, INSURRECTION, RIOT, OR ANY OTHER CAUSE BEYOND THE RELEASED PARTIES' SOLE CONTROL.
BY PARTICIPATING IN THE SWEEPSTAKES, PARTICIPANTS ACKNOWLEDGE THAT THE SWEEPSTAKES IS IN NO WAY SPONSORED, ENDORSED OR ADMINISTERED BY, OR ASSOCIATED WITH, ANY SOCIAL MEDIA PLATFORMS ON WHICH IT MAY BE PROMOTED (E.G., FACEBOOK, INSTAGRAM, TWITTER, ETC.). PARTICIPANTS AGREE TO COMPLY WITH ALL TERMS AND CONDITIONS AND POLICIES OF SUCH PLATFORMS.
